2.1     LEGISLATION IN THE ENERGY SECTOR

■       New Rules for Vulnerable Energy Consumers

17 September 2026 – A draft government regulation has been submitted for consultation procedure that redefines the categories of vulnerable electricity and gas consumers.

The proposal includes households, small consumers, social service facilities, child protection and social guardianship institutions, selected apartment buildings, homeowners’ associations, and groups of apartment owners ensuring heat production and domestic hot water heating. For electricity, the proposed annual consumption threshold for small consumers is 30,000 kWh and for gas, 100,000 kWh.

The proposal follows the recent amendment to the Energy Act and is expected to enter into force in November 2026, while certain new categories of vulnerable electricity consumers would be subject to the special regime only from 1 January 2027.

You can find the proposed government regulation and the accompanying documentation HERE. (Available only in the Slovak language version.)

■       Amendment to the Decree on Emergency Measures in the Electricity and Gas Sectors

18 September 2026 – An amendment to the decree on emergency situations in the electricity and gas sectors (No. 416/2012 Coll.) was submitted for consultation procedure.

The most significant change is the introduction of the possibility of planned interruption of electricity generation in the event of significant electricity surpluses in the system, particularly from renewable energy sources connected to distribution systems, where such surpluses cannot be compensated by standard system operation tools.

The proposed effective date is 1 January 2027.

More information about the proposed decree, as well as the accompanying documentation, can be found HERE. (Available only in the Slovak language version.)
